Terms of Service

Your account

• You need an account to keep your collection in sync across devices, vote, comment, or subscribe.
• You must be at least 13 years old to create an account.
• Give a real email address you can read, and keep your password to yourself. You are responsible for what happens under your account.
• One person per account. Do not use someone else’s account or pretend to be someone you are not, including in your username or display name.

Ciyage Extrait

Ciyage Extrait is an optional paid membership. It costs $4.99 a month, or $36 a year, in US dollars. Payments are processed by Stripe.

• Your membership renews automatically at the end of each month or year, and your card is charged for the next period, until you cancel.
• You can cancel at any time in Account, under Billing. You keep Extrait until the end of the period you have already paid for, and you are not charged again. Until then you can resume your plan from the same place.
• Payments are not refundable, and we do not give refunds or credits for part of a period, except where the law requires it or as set out under Ending your use.
• Deleting your account cancels your membership straight away. Extrait ends at once, and the rest of the period you paid for is not refunded.
• If we change the price, we will tell you before the new price applies, and it will only apply from your next renewal.

What you post

You keep ownership of what you add to Ciyage: your comments, reviews, profile photo, shelf and the names you give things. By adding it, you give Ciyage a worldwide, non-exclusive, royalty-free licence to store, copy and display it in order to run the service, including showing it publicly where you have made it public, such as your comments and a shelf you share.

This licence ends when you delete the content or your account, with one exception: when you delete your account, your comments, and the replies under them, come off the site, but we keep the text of your comments, no longer linked to you, and the licence continues for that stored copy until you ask us to erase it. To have that text erased, or any comment taken down, write to us.

You are responsible for what you post, and you must have the right to post it.

Acceptable use

When you use Ciyage, do not:

• harass, threaten or abuse anyone, or post hateful, sexual or illegal content;
• post spam or advertising, or post someone else’s private information;
• post material you do not have the right to share, such as someone else’s photos or writing;
• use more than one account, or automated tools, to manipulate votes, rankings or comments;
• scrape or copy the catalog in bulk, or access Ciyage by automated means beyond ordinary browsing;
• try to break, overload or get around the security of the service.

We may remove content that breaks these terms, and we may suspend or close accounts that do.

Fragrance information and recommendations

The catalog, its notes, images and prices are gathered from brands, retailers and other public sources. We work to keep it accurate, but it can be incomplete or out of date. Recommendations and community votes are suggestions and opinions, not advice. Check with the seller before you buy, and patch-test a fragrance if you have sensitive skin.

Seller links

Ciyage does not sell fragrances. Every link to a seller is an affiliate link, and Ciyage may earn a commission when you buy through it. That never changes the price you pay, and sellers cannot pay to change the order of the list, which is sorted by price. When you buy from a seller, the sale is between you and that seller, and their terms cover the product, delivery and returns. Prices shown on Ciyage can change on the seller’s site.

Names, trademarks and images

The Ciyage site, its design and its own writing belong to Ciyage. Fragrance and brand names are the trademarks of their owners and are used only to identify the products. Product photographs belong to their owners. If you own something shown on Ciyage and want it removed, see the Contact page.

Disclaimers

Ciyage is provided as it is and as available, without warranties of any kind, to the extent the law allows. We do not promise that it will always be available or free of errors. To the extent the law allows, Ciyage is not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the twelve months before the claim.

Ending your use

You can stop using Ciyage at any time, and delete your account in Account, under Security. We may suspend or close an account that breaks these terms. If we close your account for any other reason, we will refund the unused part of your current Extrait period.

Governing law

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Any dispute about these terms or Ciyage will be heard in the state or federal courts in Georgia, and you and we agree to their jurisdiction.

Changes to these terms

If we change these terms, we will update the date at the top of this page. If a change is significant, we will also say so on the site before it takes effect. Using Ciyage after a change takes effect means you accept the new terms.
